1. Introduction

Welcome to MotoMarketHub (“MotoMarketHub”, “we”, “us”, or “our”), a digital marketplace operated from the United Arab Emirates that connects customers with suppliers of new, used, and reconditioned automotive components. By downloading, installing, accessing, or otherwise using the MotoMarketHub mobile application (“the App”), you (“you”, “the User”) agree to be bound by these Terms and Conditions (“Terms”).

If you do not agree with these Terms, you must not install, access, or use the App. Continued use of the App after any updates to the Terms constitutes acceptance of the revised Terms.

2. Definitions

“App” means the MotoMarketHub mobile application and all related services.

“Content” means all listings, images, descriptions, messages, and other materials uploaded or shared through the App.

“Supplier” means a third-party seller of automotive parts listed on the App.

“Order” means a confirmed request by the User to purchase a listed part.

“Inquiry” means a request submitted by the User to source a specific part that may not be currently listed.

3. Our Role

MotoMarketHub acts as an intermediary platform that connects Users with Suppliers. We do not own, manufacture, sell, or hold inventory of the parts listed on the App. A contract for the sale of any part is formed directly between the User and the relevant Supplier, and MotoMarketHub is not a party to that contract.

We make reasonable efforts to verify Suppliers, but we do not guarantee the availability, accuracy, quality, safety, legality, or fitness for purpose of any listed part or any statement made by a Supplier.

4. User Accounts

To place orders, submit inquiries, or use chat features, you must register an account and provide accurate, current, and complete information. You are responsible for safeguarding your account credentials and for all activity that occurs under your account.

You must be at least 18 years of age to register and transact on the App. We reserve the right to suspend or terminate accounts that provide false information, violate these Terms, or engage in fraudulent or abusive behaviour.

5. Acceptable Use

You agree to use the App only for lawful purposes and in a manner that does not infringe the rights of, or restrict the use of, the App by any other party. You must not:

• Use the App to list, request, or trade counterfeit, stolen, illegal, or prohibited items;

• Attempt to bypass pricing, payment, or contact mechanisms established by the App;

• Reproduce, scrape, resell, or exploit Content or data from the App for commercial gain without our written consent;

• Introduce viruses, malware, or any code intended to disrupt the App, or attempt to gain unauthorised access to its systems.

6. Listings and Availability

All part listings, including descriptions, photographs, pricing, compatibility, and availability, are provided by Suppliers. MotoMarketHub does not warrant that any listing is accurate, complete, or current. Prices and availability may change without notice.

Compatibility information (such as make, model, year, and fuel type) is provided as a guide only. You are responsible for confirming that a part is suitable for your vehicle before purchasing, ideally by providing your VIN or chassis number through an inquiry.

7. Orders, Pricing, and Payment

Placing an order constitutes an offer to purchase the listed part at the displayed selling price. An Order is only confirmed once accepted by the relevant Supplier and any required payment has been successfully processed.

Unless explicitly stated, prices displayed in the App are in AED. MotoMarketHub may display approximate conversions in other currencies for convenience; the actual amount charged will be based on the AED price.

Payment is processed through secure third-party payment providers. MotoMarketHub does not store full card or payment instrument details.

8. Shipping and Delivery

Delivery of parts is arranged through third-party shippers or directly by the Supplier. Delivery times, fees, and supported destinations are indicative and may vary based on the destination, shipping method, and Supplier.

MotoMarketHub is not liable for delays, damage, or loss occurring in transit. Any shipping dispute should be raised promptly, and we will use reasonable efforts to assist you in coordinating with the Supplier or shipper.

9. Returns, Refunds, and Warranties

Return, exchange, and warranty terms are governed by the policy of the relevant Supplier and applicable UAE consumer protection law. Where a Supplier offers a warranty, the warranty period and conditions will be indicated on the listing.

MotoMarketHub may, at its discretion, facilitate communication between you and the Supplier to resolve disputes but does not guarantee a particular outcome and is not responsible for refunding purchases unless explicitly stated.

10. User Content

You retain ownership of Content you upload to the App. By uploading Content, you grant MotoMarketHub a worldwide, non-exclusive, royalty-free licence to use, reproduce, display, and transmit that Content for the purpose of operating and improving the App.

You warrant that you have the rights to any Content you upload and that it does not infringe the rights of any third party. We may remove Content that violates these Terms or applicable law.

11. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data. The Privacy Policy is incorporated into these Terms by reference.

12. Intellectual Property

All trademarks, logos, graphics, text, and software associated with the App are the property of MotoMarketHub or its licensors and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from the App without our prior written consent.

13. Disclaimers and Limitation of Liability

The App is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, MotoMarketHub excludes all warranties, express or implied, relating to the App and disclaims liability for any direct, indirect, incidental, consequential, or special damages arising out of your use of, or inability to use, the App.

MotoMarketHub’s aggregate liability for any claim arising out of or relating to these Terms or the App shall not exceed the total amount you paid to MotoMarketHub in connection with the transaction giving rise to the claim, if any.

14. Indemnification

You agree to indemnify and hold harmless MotoMarketHub, its officers, employees, and partners from any claims, damages, losses, or expenses (including legal fees) arising out of your breach of these Terms, your misuse of the App, or your violation of any law or third-party rights.

15. Prohibited Transactions

The App may not be used to source, list, or transact in parts that are illegal, stolen, counterfeit, or otherwise prohibited under UAE law, including components bearing tampered or altered identification numbers. We reserve the right to report suspected illegal activity to the relevant authorities.

16. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the United Arab Emirates. Any dispute arising out of or in connection with these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved, the dispute shall be submitted to the exclusive jurisdiction of the competent courts of the Emirate in which MotoMarketHub is registered.

17. Changes to These Terms

We may revise these Terms from time to time. The most current version will be available in the App with the “Last updated” date noted above. Material changes will, where appropriate, be notified through the App or by email. Your continued use after the effective date constitutes acceptance of the updated Terms.
